That situation sucks, but I think the best you're entitled to is paint repair. I don't think you'd get any less for your truck if you sold it (after paint repair) than you would had you sold it without being scratched. My last car was actually rear-ended before I made the first payment on it. The damage was minor -the rear bumper had a 2-3" split, that had to be patched and painted. It did have a police report, and thus a carfax ding.
2.5 years later Carmax appraised it, and I brought up the accident. The appraiser said if
the damage was superficial, ie no panels replaced, frame wasn't bent, etc, that it made no difference on trade-in value. He said that they repaint bumpers on most of the trade-ins due to scratches, stone chips, etc. No biggie.

You could go after the middle east and the environmentalists for diminished value. As gas prices rise, our truck values will fall...
