I've tried to isolate when this happens, but it happens on flat terrain with the EM brake applied, etc...no pattern.

You do know you have to apply the brake to get it out of park don't you? Just asking. Some people do this out of habit but when they forget, then it's stuck in park. I honestly saw a rental car that was driven for days with no problem. The driver didn't know he had to step on the brake to get it out of park but had been doing it without even realizing it until this one time. He broke the shifter handle clean off trying to get it in gear. He simply didn't step on the brake pedal.
If you did know this, then it might be the switch that releases the lever when you step on the brakes.
