Honestly... you have no case against anyone... Toyota does not make up the MPG rating.... I know you know this... What is your basis for this lawsuit... bad gas mileage??? good luck dude. I had an accord Hybrid that sticker said 36 mpg... best i ever did was 24mpg... that is way off...not once did I try and sue someone.

Bottom line is you should have taken the thing for a long test drive and watched the instant mpg and the average... not a perfect calc but better than complaining after the fact...

want my sequoia... ill trade you... take my 12mpg

as far as calibration goes... by law toyota only needs to calibrate the speedometer for 1 version... the base model... every other model is a upgrade so your milage will be off quite a bit... I just had this issue with Honda who is being sued for odometer fraud...huge lawsuit.

so if a base seinna has 15 inch wheels ... and yours are 17" (assuming larger size overall) you will get less miles vs the base seinna... maybe way less (12%)

I wonder what the new 3.5 gets????

BTW... Im getting rid of the sequoia for a seinna xle limited now... a year with this 07 limited is enough... cant believe the sienna has a way better feature package and is more refined than a $51000 suv... how silly is that

Anyway...good luck on your lawsuit
