Default Second Gen DC Subwoofer Box Height??

There are numerous threads around here about box designs for the '07+ DC and my head is spinning with all of the options. I'm bound and determined to not use all of the space underneath the driver side section of my rear seat so I'm thinking about a single JL 10W1. This is the only sub I've found that has all the qualities I'm looking for (price, quality, enclosure volume, mounting depth). I have successfully modeled a box in AutoCad for the 10W1 that takes 16.5" of width starting from the center of my drivers side back seat. The only thing is that the box height is 5" and there will be an additional .75" to 1" above that for the sub.

My question is this: what is the tallest flat box that can be built without the interference of the back seat and without having to modify the back seat? I think a 5" tall flat box+ sub would clear with no modifications but has anyone been able to do this?

My box is 5" high. I did have to add a few spacers/washers under the seat floor mounts but that was no big deal. The subs trim rings stick up a little, but if I had to do it over (which I will) I am going to flush mount the subs.

Xmax is .375 but I would probably put the snap on grill from JL on it for protection. I'm wondering how much sound is lost by firing directly into the soft carpet/padding on the underside of the seat? Do most people normally drive around with the seat up unless there are passengers or maybe it just makes no difference?
