Be sure that you spend enough to get a good attorney if that's what you need. To be honest, the legal system is fairly slanted against defendants. It's a little bit sad, but it's kind of like a witchhunt. It's easier if you lie and say you're a witch then if you maintain the truth and say you aren't. Here in California, there are provisions for gettting things expunged, but in certain circumstances, that's not the same as it never happening.
But the difference between a good attorney and great attorney is not that much and the second are worth their weight in gold.

IMHO, that is what is wrong with this country as a whole. They have infested our nation and state capital. One can't tell them anything, they ALL know it all. I can't stand them. All I can say is if you get one be sure you get a good one. Law is not about fairness or equity. It's about the rule of law. A good one is much more likely to get done what you want to get done.
As an example. There was a case in the news about the "McMissile" woman in North Carolina. She was wrong to do it even under the circumstances that happened, but there is the wife of a soldier who is doing his third term in iraq and she threw a cup of ice into the open window of a car that cut her off twice. It was kind of trying circumstances the second time he cut her off in bumper to bumper traffic while her sister was having premature contractions (pregnant).
She ended up getting two years in prison for it. It was stupid to do it in the first place, but getting two years in prison for thowing ice at someone is ridiculus. But it qualifies as a "missile" even if it's thrown and the minimum is two years. Even the guy that called the cops originally because they got the McDonalds cup thrown in their car thought that at worst the woman was going to get some kind of community service and that was enough. But a felony!
Now they're going to pay $25,000 a year for two years to house this woman plus someone is going to have to take care of the three kids.
It's absurd, but as I said. Law is not about equity or fairness it's about the letter of the law. So make sure the "letters" are on your side or at least can reasonably twisted that way.
I feel for this woman because half the problem with being in prison isn't the fact that you're jailed or that you've got to deal with other convicts but that you have to deal with the cops. Or more correctly the correctional officers. Some of them must be related to Saddam Hussein if not in blood, in spirit. It's kind of amazing what people will do to other people when they have almost total control over them.

That story above is just plain sad. I think that justice was NOT served. You are right, when something goes to trial that the letter of the law takes over. IF you don't have to money to get a good lawyer, you are probably going to jail. She is NOT a criminal in my opinion. Maybe she did over react to the circumstances, but gee whiz with NO criminal background and due to the stress in her life, WHERE IS MERCY. That case really makes me mad in how something so trivial can almost ruin a person's life. It is just plain sad and uncalled for.
Even the people who were on the receiving end of the mcmissile thought the penalty absurdly outweighed the crime and they were the ones who got the sticky mess on them.
Like I said, if you *need* an attorney for criminal law you can't scrimp and think that they are all the same. A great attorney is worth 10 good attorneys and a good attorney is worth 10 average ones. A bad one can get you into more trouble than if you did it yourself. Unfortunately, you don't find out you had a bad one until it's too late.
You aren't innocent until proven guilty in spite of the phrase. If you're in court, you're 70% guilty from the start.

I'd ask around locally for a lawyer who could handle your case. Bail Bondsmen may be able to make a recommendation. Or friends or acquaintances who've been in the system. Remember, 95% of lawyers give the rest a bad name.
Here is the update on the McMissile incident. I am thankful that there was a sensible judge (lawyer) on the bench. This could have been really a hard sentence IF there had been a hard nose on the job.
