Angry Trouble with wheel dealer

This is a long story so bear with me.
Just got off the phone with the manager of an unnamed (at this time) tire and wheel dealer (I guess he could be called a "wheeler dealer").
On May 27, I went to a wheel and tire store and told the manager I was interested in the 16 x 8 Mickey Thompson Classic II's. I explained to him this website and how I have determined the stock wheel backspacing to be 4-1/2". I would presume the backspacing of the MT's to be the same. He called MT and verbally told them he needed the wheel for a Tundra. He then told me it would be 3 business days to get the wheels (and tires). I agreed to that and paid up front with credit card. I figured he is the expert and would make sure to get me the right product as I would in my business.
After 3 days I called him (note:I CALLED HIM!) and asked what's up. He said it will be 5 days. OK, after 5 days he says 7-10 days. Hmmm. OK after 7-10 days I thought I'd let him call me. Nothing.
Now it's 2 weeks and still no call. I drop in at his shop and he runs and picks up the phone calling MT. Says they are just now producing the wheel! It will be more time and he can't say when now. Huh?
3 weeks and I called MT in Temecula, CA. checking up on his story and they say they have them in stock. They told me the part number #368412 and I assume that is the number he ordered.
We are now near 5 weeks into this order and I called him asking whats up? I'm pretty pissed by this time. He says Wed. he should be getting them. I asked that he call me on Wed. and keep me informed. No call. I was busy and let it go.
On Mon. I called him and he says "Oh yeah, they're here, remember you were going to call ME!?" Why would I call HIM if he got them in? I've been waiting 5 weeks. He should call ME!
I go and wait 2 hours til they finally try the rim on the truck. WRONG ONE! He ordered the wrong #. I say cancel it and clear me outta there. He was not in so they supposedly can't charge back to me without his OK.
He calls the next day and says the wheels will for sure be in tomorrow. I didn't tell him to cancel and said to call me tomorrow. That's all I said. I figured if they were there tomorrow and HE called ME, I would go ahead with it.
That tomorrow was today. No call, so I went and ordered from a different dealer who did some legwork verifying the part number.
I called the first guy and he says the wheel will now be in on Friday. I tell him forget it, I've had enough, and now he says it's a special order (it doesn't say that anywhere on the invoice) and he'll have to get an OK from his district manager to credit me and starts blaming me for telling him to order the wrong wheel!He wouldn't supply me with the district manager's number either. I got that from another dealer of the same franchise.
I may hear from the manager on Friday if he calls me.
It's a long story but, am I within my rights to cancel this order without any penalty? Is this guy jerking my chain? What advice does anybody have for me or am I just a sucker?

Contact the bank that issued your credit card. They can "Charge back" the charge from the merchant and into your account.

NEVER pay up front. This guy has been using your money to pay his bills.

whizzer,

don't feel bad. you just expected good service from a wheel dealer. too bad the guy was a loser! anyways, get to his superiors as soon as possible so that they can take care of your charge right away. btw, you shouldn't have to pay for any "special order" restocking fee if it's no where on your invoice. you shouldn't have to pay for it either just because of the BS!

since a lot of us are from OC you might want to put the companys name out so that none of us will deal w/ them.

No, seriously. Happened to my roommate about two months ago. Scope your transaction record frequently, just in case. In this instance, you're more than within your rights to have the bank cancel the transaction.

I spoke to the costomer service rep. Then I got a call back from the dealer. He will charge back to my account.
BTW, he said the wheels would be in on Friday? He said now it would be Saturday. Yet another day! And then he asked if I would still be interested in them. Ha!

I know hind-sight is always 20/20, but you shoulda ordered from SummitRacing. No tax, no shipping, just a one-time fee of like $7 per order, no limit! Got 368412 (x5) delivered to my door in 5 business days.

I hope those darn wheels come in for your sake! I'd be going nuts! Speaking of nuts, don't forget the lugs!

note: sometimes the locals can get you a better deal. summit racing was asking 106 for 16x8 AR Outlaw IIs, the local big-o was asking 95 (and he'll go lower, their list is 75) + 7% tax, which is still lower than summit once shipping and other fees are dealt with.
