This is a discussion thread titled "Car Accident Question", within the Tundra forum, part of the Truck Forums category.
This accident does not involve my Tundra thank god. I was just wondering who is at fault because my mom got into a small accident today. So this is how it goes, She backed out of a parking spot and stopped because pedestrian behind her, but she got out of the spot already and wasan't moving. Then a grandpa backed out of a parking spot and backed out into my mom hitting the drivers side. I would suspect the other car is at fault because my moms car wasan't even moving and she honked at him like crazy to stop. Whats your guys opionions? Thanks.

Grandpa is at fault, if you hit a parked or stopped car it is your fault (I can't think of an example where this wouldn't apply, unless you were hit and pushed into the other).

If she was stopped and not moving and he was in reverse it should be his fault. My friend who his an attorney statted before to me that anyone in reverse is usually at fault. Since your was hit by another car it should be his fault. Did you mom call the police and get a report. Also, can she get any security camera recordings that the store may have to support her claim.
No police report, and I don't know where the accident took place and can't ask because i'm at work right now. It seems like it was the grandpas fault and I wanted your guys opinions and thank yall very much. Case closed, MODS please move to off-topic or can remove. Thank You.

the cops won't touch private property accidents. No matter what happened, it will legally remain a he said/ she said.

I was in an accident in a parking lot some 20 years ago. We called the police and the responding officer couldn't do much since it was on private property. No tickets, nothing.
I had a parking lot accident (backed my dodge dart into a cadillac's side door) when I first started driving (let's you know how old I am!) and I knew I was clearly at fault. No damage to my vehicle but my insurance paid for their damage. No police were involved.
If the old fart wont admit fault, and neither does mom, then the two usurers will work this out themselves, by analyzing the facts, and determine the guilty party, if they cant agree (they wont if theres lots of money in damage) it then goes to arbitration.
The facts so far, its private property, you Mons car has side (door) damage no where near the bumpers, his damage is at the rear bumper?
Theres no argument that he can make.
Unless mom was drifting through the lot, and rammed his bumper with her door, he will loose the case.
Thats my opinion, do not accept fault on this, be very clear with your insurer.
