Look all you have to do is fill a suit at small claims court. This will get there there attention and all you have to do is print out the complaints and you will win your case. There is no use in getting mad that is what small claims court is for.
Re: So mad at Toyota I am having trouble typing!!!
The tailgate on my truck slowly opened up just like that. No abuse, just real world usage. Without a hassle, Toyota agreed to replace it. My father's 05 Tacoma had the tailgate fail in one quick action, I loaded a snowmobile into the truck off of a snow bank. Toyota replaced it w/o hassle.
As for what Toyota thinks of the USA customers... difficult to say. There is enough "Toyota" remaining in their current products to keep me happy... those being the heavy duty over built wear and tear items, the short answer... the stuff that get's one home everyday. However, being a Toyota truck owner/builder/modder since I got my license in 1988, some of the things that got Toyota to a very hard earned place have obviously been forgotten. One who forgets where they came from will learn a hard lesson sooner or later. This thread is about tailgate failure. When you have the most fundamental part of a truck failing, well, enough said. The frame is a biggy, Toyota used box frames forever, strong and stiff.... Both aforementioned items lead to a perception of quality. Perception is reality and we have a smooshed tailgates and a jiggly frame.
I guess my point is the older Toyota trucks had very few or none of these limitations, or perceived limitations... and that is how Toyota got to where they are. Trucks you could abuse in every way. If Toyota had built the current Tundra like an 85 4x4 Pickup, they would've hit it out of the park... it would have been more expensive, and I would have gladly paid for it.
Last I will add that this stuff no longer bugs me, but at one time I was in a place where it would have... so I do understand. It's quite nice to no longer be there. Good posts, guys!

Haha.
I load a 400lb Sportbike in the bed using ramps. That's it. Well me on it, it's 600 lbs as I ride it in. The amount of weight that the gate sees is only for a split second as I ride it in rather quickly. I have done this with each American made truck and never had this type of a problem occur.
But since you're such a jokester let me ask YOU this question: when was your Tundra made??? Your signature suggests a 2008 model. If it has an early style piece of CRAP tailgate and you weigh 200 lbs or so... have someone watch the sides right where mine came apart and just give a little bounce on yours. They will say OMG it's cracking. I showed this to a friend of mine that has an 07 when he made the same foolish remark about "what did I do to mine". So, I hopped on his tailgate (just me, no bike) and the seams on both sides showed cracks right in front of him. He was horrified. As we all should be, but most of all Toyota should be embarrassed of this FACT.
Lemme know what happens to yours if it is an early style gate.

Mine was built in June 2008 in Texas so I guess it has the beefed up tail gate. And I have had on more than one occassion in excess off 900 lbs sitting on it for extended periods of time and no problems.

So did I.
I don't think I'm that old but I am that realistic. My truck is an '07, and if I jump on the tailgate, it starts to separate. But it isn't coming apart completely; if it does I'll complain, and hope for a replacement as some have evidently gotten. Or I'll buy a new one, and still be grateful that I got a pretty good truck for the dollars spent. The new one, hopefully, will be stronger than the one on there now.
It's crappy for the dealer to refuse to provide a new gate, but going to court seems like a lot of effort, for minimal return. All they need to say is you overloaded it according to what's in the manual, and then you've lost. The fact that the newer ones are reinforced is a normal improvement process, which they are not obligated to offer to people who bought the initial offering.
Best thing is to get over it, let them know you're not happy, and if you ever decide to buy another Toyota, buy it somewhere other than the dealer who refused to make you happy.
Good luck.

Re: So mad at Toyota I am having trouble typing!!!
I was behind a Silverado at the fast food joint and the center of its tailgate was bent to the point that the surround for the latch had popped off. Made me wonder if this is the "new way of life" as they all make the trucks with thinner metal.
I have been eyeballing mine and it is fine, just the same my mind has started me wondering what fix I could do similar to the newer tailgates, you slip a threaded rod from top to bottom on each side add an adjustment nut and a stove bolt.

C'mon guys, tihs has nothig to do with the eye bolts. Mine as well as many others failed the same way w/o the eye bolts. Toyota redesigned the tail gate for a reason.
