For those in the Houston, Clear lake, League City area watch out.. I've reported them to the BBB but pas this information along if you could. They are telling me that i'm SOL :mad::mad:

Customer’s Statement of the Problem:
I took my vehicle into Clear Lake Auto World to sell my vehicle and paid a consignment fee of $200 to sell my vehicle. On December 21st someone walked into Clear Lake Auto World looking for a vehicle. The owner of Clear Lake Auto World gave this person keys to my vehicle without getting any information or getting a copy of the person’s driver's licenses. After Galen Medlenka (owner of C.L.A.W) gave the my keys to someone he didn’t know he starting taking phone calls for about 10 – 15 minutes with no regards to security of my vehicle that he was supposed to sell. After he went out 10 – 15 minutes later he notices my vehicle was stolen. My vehicle was found but it has cost me over $580 to get my vehicle back and in running condition not including the damage that was done to it. I fell that due to Galen Medlenka negligence he should reimburse me for the tow and impound fee, tow bill to dealership and cost to have key made and programmed. Galen Medlenka feels that he’s not responsible for any cost even though he is the one that gave the person the keys and didn’t follow any of their normal procedures.

If you filled this with your insurace they may try and go after his insurance to collect the money spent. Also you should be owed demished value because I am sure this will show on carfax report if filled thru your insurance which makes it worth less now. Or try taking him to smaill claims court to recover your cost and loss of value.

I can understand if the truck was carried away in a tornado, or it was stolen overnight from the lot. But to be stolen on a test drive or walkaround...he should at least pay your deductible. What a loser.

i agree. loss due to damage or vandalism is usually not something they can be held liable for.

but giving the keys to someone and letting them take it is pretty much hard to get out of... if someone had broken in and stolen the keys and taken it, yeah i can see them saying they arent responsible. but for someone to be in care/custody/control of the keys and willingly hand them to someone and not watch what happens...yeah..for that they would certainly be liable....small claims court comes to mind on that...

I only had liablity on it so i can't claim anything on my insurance..
Yea i talk to a lawyer and going to take him to small claims court

Yea the lawyer said even if i signed a general contract about he not being responsibnle for lost or stolen items that it would matter in this case due to his negligence and i would win in small claims court
